India’s 3-Hour Takedown Rule.

2. What counts as "Unlawful Content"

Content that violates any Indian law, including:

Public order & national security - incitement to violence, riots

Misinformation/Disinformation during elections, disasters

Illegal AI content - deepfakes, non-consensual intimate images, child abuse material, impersonation

Sexual content - nudity, sexual acts, revenge porn

Explosives, drugs, terrorism content

Copyright/IP violations, fake documents

Govt powers come from IT Act + other laws. Platforms don’t decide legality, they must comply on notice.

3. New AI/Synthetic Content Rules

Biggest addition in Feb 2026 amendment:

Labelling: Any AI-generated or altered audio, video, image that looks real must be "clearly and prominently labelled"

Metadata: Platforms must embed permanent identifiers/metadata where technically feasible

No removal of labels: Intermediaries cannot allow users to strip off AI labels/metadata

Ban tools: Must deploy automated tools to block illegal AI content - child abuse, sexually exploitative, deceptive, false documents, impersonation

Routine editing, education, accessibility improvements are excluded.

4. Compliance Burden on Platforms

To meet 3 hours, companies need:

24/7 Nodal teams in India for govt coordination

Faster internal escalation - no time for legal review

Automated detection + takedown systems

Transparency reports on how many takedowns in 3hr window

Legal experts flag: “This assumes no application of mind” - platforms may remove first and ask later to avoid liability 

5. Penalties for Non-Compliance

If platform fails to take down in 3 hours:

Safe harbor protection under Section 79 IT Act can be lost

Govt can take action against the intermediary + hold them liable for the content

Potential fines, and in extreme cases, platform access can be blocked

6. Govt’s Reasoning

Speed of virality: Content spreads in minutes. 36 hours was too late

Public order: Prevent riots, fake news during crises

India’s scale: 624M internet users, ∼4 hours daily on social media

Global trend: Similar pressure in EU, Brazil, US for faster takedowns 

7. What’s NOT covered

User-to-user grievances still go through platform’s grievance officer first

"Unlawful" still needs an official notice. Govt can’t demand random takedowns without process

Journalistic, artistic, educational content is not automatically exempt - depends on context

Bottom line: From 20 Feb 2026, once MeitY sends a notice, Meta, X, YouTube etc have 180 minutes to pull it down or risk losing legal protection.
